The term "you" , "your" refers to all persons using The site and/or Apps.

These Terms and Conditions together with the documents referred to within the Terms and Conditions govern the supply of any products ordered by you on The site and/or Apps and your use of The site and/or Apps. By browsing, accessing, using The site and/or Apps or ordering a product, you agree to be legally bound by these Terms and Conditions.

Except as required by law (including the Australian Consumer Law) we are not responsible for inaccuracies or errors caused by incorrect information supplied to us or by these third parties.

2.4 Due to photographic and screen limitations associated with the representation of products, some actual products (including, in particular, Groceries, clothing, apparel and shoes) may differ to a small extent in visual appearance (for example in colour, freshness, quality) from the way they appear on The site and/or Apps. In addition, where it is suitable to do so, some depictions of products are created or chosen by us for promotional purposes, and may not be an exact representation of the products received.

2.5 Aladin's Chirag may use or display some of it's products from other suppliers/advertisers/vendors/drop-shippers and all of it's services may not necessarily affiliated or endorsed by the retailers on this site.

2.6 The Site and/or Apps may provide opportunities to it's members or sellers to sell or showcase their own products and/or services by their own responsibility through the site and/or app's Marketplace service. Aladin's Chirag shall not take any responsibility or would not provide any damage or refund or replace any products or any value of any purchases made by you directly from any of it's members or sellers or stores of this Site and/or Apps. As our Marketplace members and/or sellers have full control or authority to change or modify any or all of their product/service offerings by their own using separate log in and we are not capable to track that log in sessions we may not be able to provide any proof of such modifications or alterations of the product/service offering information except any intervention from our technical or third party service providers or developer team. However, we may be able to help you to settle any of your matter by requesting to the affected members/sellers to resolve any such issues amicably or upon investigation we may cancel any such membership or sellers access to our site and/or apps due to their negligence of our standard customers service agreement. Also we may be able to provide all related or contact information to any legal authority if and when necessary or requested.

3. Pricing, Ordering, Payment, Transaction fee, Cancellation and Refund:

3.1 When making an Order, you must follow the instructions on The site and/or Apps as to how to make your Order and for making changes to your Order before you submit it.

3.2 Once You select a product that you wish to order, irrespective of any previous price you have seen or heard, you will then be shown or told by us the price you must pay including GST and/or any other charges equivalent to GST associated with our country's law and regulations.

3.3 We reserves the right to amend any pricing errors displayed due to human error, computer malfunction or any other reason. We will notify you of any error in pricing and you may elect to not purchase any Good/s where the price has been corrected. Also we may perform rounding method to calculate any fractional amount less than 5 cents to the nearest transaction value while taking payment by cash or any other payment method where it is necessary or due to technical limitations.

3.4 Unless otherwise stated all charges will be applied in local currency (shop owners country and currency), example- Australian Dollars for Australian businesses. In any case, if a retailer or shop owner wish to sell any product in overseas market currencies will be converted to local currency (Shop owner's currency) on ordering date with the standard rate of exchange or individual arrangement can be done with the specific shop owner/retailer. In this instance, you should calculate applicable GST and any other custom charges, duties as per destination country's law and regulations. We are not liable to these charges in any situation or will not be able to make any deductions from the product price.

3.5 You must select one of the payment methods we provide on The site and/or Apps at the time of ordering. You must be fully entitled to use the payment method or account used for purchases. The payment method or account must have sufficient funds or credit facilities to cover the purchase. We reserve the right to obtain validation of your payment details before providing you with the product and carry out security checks from time to time. In the event of selecting Payment on Delivery or Pay Directly to Store, you must ensure that you have sufficient amount of money to pay the order in full at the time of delivery of the products. Failure or decline to pay at the time of delivery of the products with acceptable quality may attract retention or return charges and/or suspension of the account from the site and/or Apps.

3.6 You may be able to edit/add/remove products in your order until it has been picked up. Upon ordering, you will get a link to track your order status to see if you can change any order. If you discover that you have made a mistake with your Order after it has been picked up and waiting to deliver, please contact us immediately. However, we cannot guarantee that we will be able to amend your Order in accordance with your instructions in this stage.

3.7 We may reserve the right to cancel any order at any stage of picking or delivering if products are not available for any reason. We will notify you if this is the case and return any payment that you have made at our discretion and without incurring additional liabilities. We also reserve the right to cancel orders found to be fraudulent. Customers must only create and maintain one account per user.

3.8 For every order you will get a Temporary Invoice where prices are estimated based on average weight of some variable weight products that are charged per kilogram as a whole products (such as whole Fruits & Vegetables, whole Fish or Meat). The actual weight may differ slightly and that will affect the price you pay with the Final Invoice, usually at the time of delivery.

3.9 All products are "Subject to Stock Availability" at the time we would be picking from any store. We will reasonably try to contact customers regarding unavailable items and offer replacements or substitute products. If we can't reach the customer at the time of order picking for asking permission our shopper may pick up substitute items or similar products from other brands keeping the quality, quantity and price in mind. In the instance, where shoppers will replace with substitute (if out of stock) by their own variable weight products that are charged per kilogram as a whole product (such as whole Fruits & Vegetables, whole Fish or Meat) customers may be charged the higher per kilogram price of any replacement items within the advised weight range. If the value of the replacement exceeds the initial price charged to the customer, customers may be charged an extra amount.

3.10 Until the time or order status showing- 'shopper has started picking your Order'- you have the right to cancel your Order. If we or you have cancelled your Order before this stage, we will promptly refund any payment already made by you to your original payment method. However, Once an order has been processed and waiting to deliver it cannot be cancelled and the item must instead be returned to our storage in accordance with the Re-delivery or Re-stocking charges (please visit delivery information page for more details) and Return & Refund Policy.

3.11 We do not allow 'change of mind' for any kind of pre-order items selling in our website or by any other means under our ABN. The 'change of mind' policy also imply when you would not take the products by paying remaining amount. In this cases, we do not refund the booking deposit (usually 25% of the product's value) for the pre-order items. This booking money could be used to reimburse any losses we will incur from that pre-order item.

3.12 We are using an International Payment Gateway (Stripe) to process any online payment (Pay Now - an option to pay for your order) made in our website and/or apps through any credit or debit cards. To process this payment through our payment gateway partner we incur a customised charge or fee depending on the card used to pay. To cover that payment processing fee or charges we also charge a flat fee or charge ($0.30 + 02.33%) per transaction on the total payable amount for any order when customers use Pay Now (online payment) option at the checkout. We usually take this transaction fees from the sellers ONLY who wish to accept online payments from their customers. We DO NOT charge any transaction fee from the customers or any other sellers who don’t accept online payment from their customers. This transaction charges are subject to change with a notice if and when necessary as per our payment processing provider’s policy to charge for any online transaction.

3.13 Prices for products or services in the Website and/or Apps are subject to change or modify at any time without prior notice given to the customers. All prices are subject to include GST and/or other Government fees where applicable. Customers are obliged to pay these GST and/or Govt, fees as per Australian rules and regulations in this regard.

3.15 All prices are shown in our Website and/or Apps is following our very own pricing strategies. If you find any of the product's prices are same or equal to any other physical stores that are co-incident. However, as a services business, we always try to source and supply quality products with the right prices and in many of our product's price is as similar as some of the physical stores.

3.16 Aladin's Chirag, ABN: 17546275079, and any of it's products and/or services may not necessarily affiliated or endorsed or legally partnered by the retailers on this Website and/or Apps. Depending on our internal relationship with any of the Members, Store Owners, Service Providers and/or any Partners whose products and/or services we are selling through our Website and/or Apps, we may change the prices or their product and/or service's price may change in our Website and/or Apps at any time. Some product and/or service's price might be lower or equal or higher than that of their physical showroom and/or location prices.

4. Vouchers, Coupons, Referral and Reward Points:

4.1 You may use Vouchers, Coupons, Referral and Reward Points as payment for certain Products on The site and/or Apps. We may email Vouchers, Coupons, Referral and Reward Points to you. We accept no Liability for errors in the email address provided to us. We assume no Liability for the loss, theft or illegibility of Vouchers, Coupons, Referral and Reward Points. In the event of fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with the redemption of Vouchers, Coupons, Referral and Reward Points on The site and/or Apps, we are entitled to close your Account and/or require a different means of payment.

4.2 Conditions for the redemption of Vouchers, Coupons, Referral and Reward Points:

(a) From time to time we may release Vouchers, Coupons, Referral and Reward Points that may be used on The site and/or Apps. These Vouchers can only be redeemed on The site and/or Apps in accordance with the special terms and conditions stated on them.

(b) Vouchers and Coupons are valid for the specified period stated on them only. Certain Products may be excluded from voucher promotions.

(c) Vouchers, Coupons, Referral and Reward Points cannot be redeemed for cash. If you place an Order for a Product less than the value of a Vouchers, Coupons, Referral and Reward Points, no refund or residual credit will be returned to you. If the credit of a Vouchers, Coupons, Referral and Reward Points is insufficient for the Order you wish to make, you may make up the difference through payment by other means (but not by using another voucher or attempting to rely on any other offer). Please note that only one voucher can be used per Order.

(d) Vouchers are applied to invoices as a whole. Accordingly, in circumstances where multiple Products are purchased using a voucher, and one or more Products are returned, the discount is applied on a pro rata basis to each Product for the purpose of establishing refund values.

(e) We actively monitor misuse of vouchers and reserve the right to block any person that is not using a voucher in accordance to its terms and conditions.

d) Referral discounts will not be valid if the referral address is the same as that of the referrer

5.Email, Text SMS and Push Notification Communication

Aladin's Chirag may also provide you with information and updates regarding our Apps, website and changes to the law from time to time. we may also make you aware of our new and additional products, services and marketing information via email, text SMS and push notifications on the mobile platform. This service is free and you can unsubscribe at any time by clicking the unsubscribe link provided with every email or from your mobile notification setup or from your Chirag Account profile page. Alternatively, you can reply us to remove your email from our mailing list.

However, it is our minimum standard communication policy to send you certain important documents regarding your purchase (i.e. Invoices / Tax receipts) and we may notify you regarding any legal issues or changes to our terms of use policy through either way of communications even if you turn off your notification or unsubscribe from our newsletter or limit your email preferences.

6. FREE Basic Membership Terms & Conditions Policy (Cancelled as of 13 May 2020):

Considering current situation, we have cancelled this policy of "Free Basic Membership" for Home based business owners. This cancellation will be effective as of 13 May 2020 until further notice. We are really sorry if anyone still want to come across to take this offer as this offer is no longer valid from the above mentioned date.

7. Mediation and Dispute Resolution:

In the event of any dispute under these Terms and Conditions the parties (The site and/or Apps, Retailers/ Shop owners and Customers) agree to negotiate in good faith to resolve the dispute. Any dispute or difference whatsoever arising out of or in connection with these Terms and Conditions which cannot be resolved by the parties shall be submitted to mediation in accordance with, and subject to, The Institute of Arbitrators & Mediators Australia, Mediation and Conciliation Rules. All mediation or court proceeding would he held either at Liverpool NSW 2170 or Sydney CBD 2000.

8. GENERAL

8.1 Entire agreement: These Terms and Conditions contain all the terms agreed between the parties regarding its subject matter and supersedes and excludes any prior agreement, understanding or arrangement between the parties, whether oral or in writing. No representation, undertaking or promise shall be taken to have been given or be implied from anything said or written in negotiations between the parties prior to these Terms and Conditions except as expressly stated in these Terms and Conditions. However, the service and products are provided to you under our operating rules, policies, and procedures as published from time to time on The site and/or Apps.

8.2 Force majeure: We shall not be liable for any breach of our obligations under these Terms and Conditions where we are hindered or prevented from carrying out our obligations by any cause outside our reasonable control, including by lightning, fire, flood, extremely severe weather, strike, lock-out, labour dispute, act of God, war, riot, civil commotion, malicious damage, failure of any telecommunications or computer system, compliance with any law, accident (or by any damage caused by any of such events).

Software bugs will be fixed on a best endeavours basis and can be reported via the App stores or by emailing to us.

Product pictures in the website may differ with the physical product(s) in colour, contrast or any other means for various factors including, but not limited to, screen resolution, our sourced image quality, supplier's capability to present the product in correct lighting, human error, uploading slightly different coloured products and so on. Nothing we can where we do not have any control except refunding your money for that particular product(s). If you do not wish to keep that product simply return to us and we would refund your paid amount (except the shipping charges) straight away.

10. Definitions:

In these Terms and Conditions unless the contrary intention appears:

· Account means the account that you will need to register for on The site and/or Apps if you would like to submit an Order on The site and/or Apps in accordance with clauses of the Terms and Conditions;

· Business Day means a day which is not a Saturday, Sunday or a public holiday in Sydney Australia;

· Delivery Fee means any charges you are liable to have the products delivered to you;

· Concierge fee means any charges you are liable to pick your ordered products from any shop(s) by our associate or any of our shoppers;

· GST means the Goods and Services Tax;

Transaction Fee or Charges means any fee or charges incurred from the payment gateway provider of our site and/or apps to process any online payment made by the customers at the time of ordering any value of products. Usually the fee is $0.30+02.33%.
